In brief
- Who it is for
- Residents, property owners and businesses affected by a municipal decision, fine or action, in particular by Barcelona City Council.
- Where to file
- Through the City Council's electronic register or its registry offices. In Barcelona, traffic fines are managed by the Municipal Tax Institute (Institut Municipal d'Hisenda), which offers an online procedure for representations and appeals.
- Key time limits
- Traffic fines: 20 calendar days to contest or pay at the reduced rate. Appeal for reconsideration: one month. Court appeal: two months from notification of the decision.
- Fees
- We quote them in the first consultation (€40), with the option to pay in instalments.
What it covers
- Optional appeal for reconsideration, within one month, against decisions of the Council Plenary, the Mayor or the Governing Board, which end the administrative stage.
- In Barcelona, hierarchical appeal (recurso de alzada) to the Mayor against district decisions that settle the substance of the matter.
- In Barcelona, hierarchical appeal within one month against acts applying municipal taxes and other public revenue, reviewed by the Tax Council (Consell Tributari).
- Traffic fines: representations and evidence within 20 calendar days of notification or, if you were not driving, identification of the driver within the same period.
- Against a traffic penalty, as a rule, an appeal for reconsideration within one month; on its own it does not suspend enforcement of the fine.
- Appeal to the administrative courts within two months of notification of the decision that ends the administrative stage.
- Complaints to Barcelona's Ombudsman (Sindicatura de Greuges) when the municipal service has not responded or resolved the issue.
How we help you
-
We study the notice
We check what decision you have been notified of, which body issued it, which appeal applies and the deadline for filing it, and look for any defects in notification or limitation.
-
We review the file
We request access to the file and the evidence, such as photographs of the offence, and explain your options clearly, including paying at the reduced rate.
-
We file the appeal
We draft the representations or appeal with supporting evidence and file it in time through the electronic register or the relevant municipal channel.
-
Follow-up and court
We follow the case until a decision is made. If it is unfavourable or no decision is issued, we consider with you an appeal to the administrative courts.
Frequently asked questions
Should I pay the fine with the 50% discount?
It depends. For most offences, paying within 20 calendar days of notification halves the fine, but you waive your right to contest it and the procedure ends; afterwards only a court appeal is possible. If you think the fine is wrong, have it reviewed before paying.
What happens if I do nothing after receiving a traffic fine?
For many offences, if you neither contest nor pay within 20 calendar days, the notice takes effect as the penalty decision and the fine can be enforced 30 calendar days after notification. That is why you should act within that period.
Does a complaint to the Sindicatura de Greuges stop the appeal deadlines?
No. Barcelona's Ombudsman can step in if you first complained to the municipal service without a response or solution, but complaints do not affect the time limits for administrative or court appeals. The appeal must still be filed in time.
